SUBJECT: Contract Award of Tamien to Lick Double Track Construction for the Caltrain Service Improvement Program


RECOMMENDATION:

Authorize the General Manager to execute a contract with the joint venture of R & L Brosamer/Stacy and Witbeck, Inc. the lowest responsible bidder, in the amount of $9,165,568 for civil and track construction from the Caltrain Tamien Station to the Lick control point (approximately 2.7 miles).  This contract is 100% funded by the California State Traffic Congestion Relief Program.

BACKGROUND:

The Caltrain Service Improvement Program will support service level increases through facility and track capacity improvements between Gilroy and Palo Alto.  This contract will construct a second mainline on the west side of the existing Union Pacific Railroad and effectively extend double track between San Jose and the Coyote Valley area, thereby minimizing freight and passenger operational conflicts.  Work in this contract will also include seismic upgrades and repairs to Alma Street West and Almaden Road railroad bridges, replacement of private crossing structures and construction of a retaining wall.

Construction for this contract is scheduled to begin in September 2002.  Completion is scheduled for August 2003.

DISCUSSION:

The Tamien to Lick Double Track construction contract for the Caltrain service Improvement Program was advertised on May 3, 2002 and complied with VTAs contractor pre-qualification requirements.  Two bids were received on July 17, 2002, with the following bid results:

                    R&L Brosamer, Inc./Stacy                        $  9,165,568
                    and Witbeck, Inc.
                    Metroplex Corporation                               $10,717,000

                                   Engineer's Estimate                  $10,952,505
                                   Project Budget                          $15,500,000

R&L Brosamer/Stacy and Witbeck Joint Venture is the lowest responsible bidder.  The bid is 16% lower than the Engineers Estimate.  VTA staff recommend contract award to the Joint Venture of R&L Brosamer/Stacy and Witbeck, Inc.  Both companies have a good performance record with VTA on active and completed construction contracts.

Also, the Board should be aware that the California Public Utilities Commission(CPUC) has taken an adversarial position on the requirement for two public and two private grade crossing applications under General Order 88A.  This General Order involves the modification to an existing grade crossing.  Since VTA is not making any changes to these existing grade separations, VTA counsel has advised that General Order 88A applications to the CPUC are unnecessary.  Upon award of this contract VTA intends to proceed with construction without General Order 88A applications.

ALTERNATIVES:

There are no practical alternatives to the recommended action.

FISCAL IMPACT:

Sufficient funds are available to perform this work.  The Tamien to Lick Double Track Project is funded by the State under the Traffic Congestion Relief Program.

SMALL BUSINESS ENTERPRISE (SBE) PARTICIPATION:

Based on identifiable subcontracting opportunities, a SBE goal of 14.0 % was established for this contract.

Contractor was not able to meet the SBE goal, but was able to submit documentation of good faith effort.  Based on review of the documentation, it was determined that the contractor provided sufficient good faith effort to comply with the SBE requirements.

Contractor has committed to 3.3% SBE participation on this contract.
