Community Oriented Design Enhancements (CODE) Program Artist Service Agreement |
RECOMMENDATION:
Authorize the General Manager to execute a service agreement with San Jose artist Diana Pumpelly Bates in the amount of $584,000 for design, fabrication and installation of CODE projects for the Vasona Light Rail Project.
BACKGROUND:
In January 2000, Santa Clara Valley Transportation Authority (VTA) established the CODE Program to ensure that 1996 Measure B Program Projects integrate the highest quality design enhancements that reflect the identity of the communities and neighborhoods where they are located. The Santa Clara Board of Supervisors and VTA Board of Directors approved CODE funding of $7.2 million for 1996 Measure B Rail Projects. This CODE budget includes $1.8 million for the San Jose segment of the Vasona Light Rail Project.
The CODE Committee, composed of three representatives of each city with an eligible 1996 Measure B Transportation Project, provides oversight for the CODE Program. The cities lead the public involvement for input on proposed concepts and determine their citys review and approval process.
DISCUSSION:
Over the past three years, VTA staff and the Lead Program Artist have worked closely with the City of San Jose to develop CODE concepts for the San Jose segment of the Vasona Light Rail Project. Initial concepts were presented to the CODE Committee and the Transit Planning and Operations Committee. After San Jose selected its preferred concepts, a review board selected artists to design, fabricate and install the individual projects. The review board included San Joses CODE Committee representatives and other staff members, as well as VTAs light rail project manager, and the CODE Lead Program Artist.
San Jose artist Diana Pumpelly Bates was selected to create shelter canopy glass projects for the San Jose Diridon, Race, Fruitdale, and Bascom Stations, and a railing project for the San Jose Diridon Station.
The CODE Lead Program Artist developed the contract amounts for each artwork project based on input from the selected artists, VTAs Rail Design and Construction staff and consultants, fabricators and his extensive experience as an artist.
The artist will work with VTA staff and the Lead Program Artist to ensure adherence to the Vasona Projects construction schedule and artwork budgets. At several key points during the design and fabrication phases, the artist will present her work to the CODE Committee for its review and approval. (Ms. Bates has already developed a concept proposal for the San Jose Diridon Station that was presented to the CODE Committee at its November 2002 meeting).
ALTERNATIVES:
If the artist contract is not approved, it will delay the CODE projects design phase.
FISCAL IMPACT:
The funds are included in the Vasona Light Rail Project CODE budget.
SMALL BUSINESS ENTERPRISE (SBE) PARTICIPATION:
No specific goal has been established for this contract due to the lack of SBE firms available to perform the scope of work. Contractor is encouraged to make reasonable efforts to utilize SBEs in its procurement of ancillary services and products associated with the performance of this contract.
