SUBJECT: Noise Mitigation for Vasona Light Rail Project

RECOMMENDATION:

Authorize the General Manager to execute a contract with the lowest responsible bidder, Tron Construction, Inc., in the amount of $635,000, for construction of Noise Mitigation on the Vasona Light Rail Project. 

BACKGROUND:

This contract provides noise mitigation for certain residences located along the Vasona Light Rail Project.  The noise mitigation work is a requirement of the Environmental Impact Report/Environmental Impact Statement (EIR/EIS) for the Vasona Light Rail Project. 

This contract will provide noise insulation at approximately 117 units along the Vasona rail corridor in the City of San Jose and City of Campbell.  The improvements consist primarily of the replacement or treatment of windows and doors to achieve the California Noise Insulation Standard of 45 dBA.  The improvements will take place at residences where noise impact was identified, but could not be mitigated with sound walls alone.  

Construction for this contract is scheduled to begin in January 2004, with completion scheduled for September 2004. 

DISCUSSION:

The Vasona Noise Mitigation contract was advertised on August 27, 2003 and four bids were submitted on October 2, 2003, with the following bid results:

                       Chegwin Construction                         $   810,804
                       PENCON                                             $   915,700
                       G.E. Chen Construction                       $1,045,310

                                     Engineers Estimate:             $   675,360
                                     Project Budget:                     $   800,000

Tron Construction, Inc. is the lowest responsible bidder.  The bid is 6% lower than the Engineers Estimate and VTA staff recommends award.

ALTERNATIVES:

There are no practical alternatives to the recommended action.

FISCAL IMPACTS:

Sufficient funds are available in the Vasona Light Rail Project budget to perform this work.  An amount of $299,163 is funded by the 1996 Measure B Transportation Improvement Program  (MBTIP) for work within the City of San Jose and City of Campbell.  The remaining $335,837 for the Winchester segment in the City of Campbell is funded by the State of California.

SMALL BUSINESS ENTERPRISE (SBE) PARTICIPATION:

Based on the limited scope of work and no subcontracting opportunities, no specific goal has been established for this contract.  Contractor is encouraged to make reasonable efforts to utilize SBE in its procurement of ancillary services and products associated with the performance of this contract.
