The prior Bus Testing Regulation (which does not assign or require a score or Pass/Fail rating) remains in effect through October 30, 2016. Even after the October 31, 2016 effective date of the new Final Rule, existing Bus Testing Reports (without a score or Pass/Fail rating) will remain valid as long as the bus model they apply to continues to be produced without major changes. The date that the contract between a manufacturer and the Bus Testing Center is executed will determine whether the requirements of the previous Bus Testing Regulation or the new Bus Testing Regulation will apply when buses are submitted for new full or partial tests. • Testing contracts signed on or before October 30, 2016 are subject to the old requirements and will not receive a score or rating, even if testing continues past October 31. • Testing contracts signed on or after October 31, 2016 will be conducted under the new procedures, and that bus model will receive a score and a Pass or Fail rating. This applies to both contracts for full testing, and contracts for partial testing. • A contract signed on or after October 31, 2016 for partial testing on a bus will receive scores for the partial tests performed.
